Terms of Service

1. Acceptance of Terms

By accessing or using Velar ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including those who access the Service via the web dashboard, CLI, or API.

2. Description of Service

Velar provides a static site deployment platform that allows users to upload, host, and serve static websites via a global edge network. The Service includes a web dashboard, command-line interface (CLI), and API for managing deployments, projects, and account settings.

3. Account Registration

To use the Service, you must create an account by providing a valid email address and password. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Ensuring your account information is accurate and up-to-date

4. Acceptable Use

You agree not to use the Service to:

  • Host, distribute, or link to malware, phishing pages, or malicious content
  • Violate any applicable laws, regulations, or third-party rights
  • Distribute copyrighted content without authorization
  • Host content that promotes hate speech, violence, or discrimination
  • Conduct denial-of-service attacks or attempt to disrupt the Service
  • Use the Service for cryptocurrency mining
  • Attempt to gain unauthorized access to other users' accounts or data
  • Resell or redistribute the Service without authorization

5. Content Ownership

You retain all rights to the content you deploy through the Service. By uploading content, you grant Velar a non-exclusive, worldwide license to host, serve, cache, and distribute your content solely for the purpose of providing the Service.

We do not claim ownership of your deployed content and will not use it for any purpose other than operating the Service.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may temporarily suspend access for maintenance, upgrades, or emergency repairs. We will make reasonable efforts to provide advance notice of planned downtime.

7. Subdomains & Custom Domains

Each project receives a subdomain under velardev.app (e.g., your-project.velardev.app). Subdomain names are allocated on a first-come, first-served basis. We reserve the right to:

  • Reclaim subdomains that violate these terms
  • Reclaim subdomains that are inactive for extended periods
  • Reject subdomain names that are misleading, offensive, or impersonate others

8. Rate Limits & Fair Use

The Service may impose rate limits on API requests, deployments, and bandwidth to ensure fair usage for all users. Free-tier accounts are subject to reasonable usage limits. We reserve the right to throttle or suspend accounts that exceed fair use thresholds.

9. Termination

You may terminate your account at any time through the dashboard or by contacting us. We may terminate or suspend your account if you violate these terms. Upon termination:

  • Your deployed sites will be taken offline
  • Your data will be deleted within 30 days
  • Your subdomain will be released for reuse

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VELAR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Indemnification

You agree to indemnify and hold Velar harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your content, or your violation of these terms.

13. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or a prominent notice on the Service. Continued use of the Service after changes constitutes acceptance of the modified terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.
